1. Titular del servicio

EA Monitor (en adelante, "el Servicio") es operado por Ana Millán Mesonero, autónomo con domicilio en C/ Virgen del Pilar nº 20, 4º, 46180 Benaguacil (Valencia), España, con NIF 53359835L. Puedes contactar en cualquier momento en eamonitor@proton.me.

El acceso y uso del Servicio implica la aceptación de estos Términos. Si no estás de acuerdo, no utilices el Servicio.

2. Descripción del Servicio

EA Monitor es una herramienta de software (SaaS) de analítica y monitorización que permite al usuario seguir el rendimiento de sus propias estrategias automáticas de trading (Expert Advisors) en MetaTrader 4 y MetaTrader 5, y compararlo con sus datos de backtest, mostrando métricas, alertas e informes en un panel.

3. Lo que el Servicio NO es

Es importante que entiendas el alcance del Servicio:

No proporciona asesoramiento financiero ni de inversión, ni señales de trading, ni recomendaciones de ningún tipo.
No ejecuta operaciones ni se conecta a tu bróker para operar en tu nombre.
No gestiona, custodia ni transfiere fondos de ningún tipo.
Se limita a leer datos de rendimiento de cuentas que ya son tuyas, para fines de información y análisis.

4. Registro y cuenta

Para usar el Servicio debes crear una cuenta facilitando datos veraces y mantener la confidencialidad de tus credenciales. Eres responsable de toda la actividad bajo tu cuenta. Debes ser mayor de edad y tener capacidad legal para contratar.

5. Suscripciones, precios y facturación

El Servicio se ofrece mediante suscripción de pago (mensual o anual) según los planes y precios publicados en la web. Los pagos se procesan a través de nuestro proveedor de pagos. Las suscripciones se renuevan automáticamente al final de cada periodo, salvo cancelación previa. Podemos modificar los precios, comunicándolo con antelación y aplicándolo a partir de la siguiente renovación.

6. Cancelación y reembolsos

Puedes cancelar tu suscripción en cualquier momento. Al cancelar, mantienes el acceso hasta el final del periodo ya pagado y no se te cobrarán periodos posteriores. Las condiciones se detallan en nuestra Política de Reembolsos.

7. Uso aceptable

Te comprometes a no usar el Servicio de forma ilícita ni a: (i) intentar acceder a cuentas o datos de terceros; (ii) realizar ingeniería inversa, copiar o revender el Servicio; (iii) sobrecargar o interferir en la infraestructura; (iv) introducir código malicioso. El incumplimiento puede conllevar la suspensión o cancelación de tu cuenta.

8. Propiedad intelectual

El Servicio, su software, marca, diseño y contenidos son propiedad del titular o de sus licenciantes. No se concede ninguna licencia más allá del derecho de uso del Servicio conforme a estos Términos. Los datos que introduces o sincronizas siguen siendo tuyos.

9. Disponibilidad

Hacemos esfuerzos razonables por mantener el Servicio disponible, pero se presta "tal cual" y "según disponibilidad", sin garantía de funcionamiento ininterrumpido o libre de errores.

10. Limitación de responsabilidad y riesgo

El Servicio es una herramienta informativa. Las decisiones de trading son exclusivamente tuyas. Operar en los mercados conlleva riesgo de pérdida, y los resultados pasados no garantizan resultados futuros. En la máxima medida permitida por la ley, el titular no será responsable de pérdidas económicas, de trading o indirectas derivadas del uso del Servicio o de la fiabilidad de los datos mostrados.

11. Protección de datos

El tratamiento de tus datos personales se rige por nuestra Política de Privacidad.

12. Modificaciones de los Términos

Podemos actualizar estos Términos. Te informaremos de los cambios sustanciales y la versión vigente estará siempre disponible en esta página.

13. Ley aplicable y jurisdicción

Estos Términos se rigen por la legislación española. Para cualquier controversia, y cuando la normativa lo permita, las partes se someten a los juzgados y tribunales correspondientes, sin perjuicio de los derechos de los consumidores.

1. Service owner

EA Monitor (the "Service") is operated by Ana Millán Mesonero, a self-employed sole trader domiciled at C/ Virgen del Pilar nº 20, 4º, 46180 Benaguacil (Valencia), Spain, tax ID (NIF) 53359835L. You can contact us anytime at eamonitor@proton.me.

Accessing and using the Service implies acceptance of these Terms. If you do not agree, do not use the Service.

2. Description of the Service

EA Monitor is an analytics and monitoring software tool (SaaS) that lets users track the performance of their own automated trading strategies (Expert Advisors) on MetaTrader 4 and MetaTrader 5, and compare it against their backtest data, showing metrics, alerts and reports in a dashboard.

3. What the Service is NOT

It is important to understand the scope of the Service:

It does not provide financial or investment advice, trading signals, or recommendations of any kind.
It does not place trades nor connect to your broker to trade on your behalf.
It does not manage, custody or transfer funds of any kind.
It only reads performance data from accounts that are already yours, for information and analysis purposes.

4. Registration and account

To use the Service you must create an account providing accurate information and keep your credentials confidential. You are responsible for all activity under your account. You must be of legal age and have capacity to contract.

5. Subscriptions, pricing and billing

The Service is offered via a paid subscription (monthly or annual) according to the plans and prices published on the website. Payments are processed through our payment provider. Subscriptions renew automatically at the end of each period unless cancelled beforehand. We may change prices, giving prior notice and applying changes from the next renewal.

6. Cancellation and refunds

You may cancel your subscription at any time. Upon cancellation, you keep access until the end of the already-paid period and will not be charged for later periods. Conditions are detailed in our Refund Policy.

7. Acceptable use

You agree not to use the Service unlawfully or to: (i) attempt to access third-party accounts or data; (ii) reverse engineer, copy or resell the Service; (iii) overload or interfere with the infrastructure; (iv) introduce malicious code. Breach may lead to suspension or termination of your account.

8. Intellectual property

The Service, its software, brand, design and content are owned by the owner or its licensors. No license is granted beyond the right to use the Service under these Terms. The data you enter or sync remains yours.

9. Availability

We make reasonable efforts to keep the Service available, but it is provided "as is" and "as available", without warranty of uninterrupted or error-free operation.

10. Limitation of liability and risk

The Service is an informational tool. Trading decisions are solely yours. Trading the markets carries a risk of loss, and past results do not guarantee future results. To the maximum extent permitted by law, the owner shall not be liable for financial, trading or indirect losses arising from use of the Service or the reliability of the data shown.

11. Data protection

The processing of your personal data is governed by our Privacy Policy.

12. Changes to the Terms

We may update these Terms. We will inform you of material changes and the current version will always be available on this page.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, and where the law allows, the parties submit to the relevant courts, without prejudice to consumers' rights.
